Parties and the Law

Can I be ticketed for having a party?

The answer is often “Yes”.  Below is relevant Village Code Ordinance that the Police Department is called on to enforce when receiving complaints involving parties being held within the Village. 

55-3b(1):  Any unnecessary noise from any sources which are of such character, intensity and duration as to be detrimental to the life or health of any individual or contrary to the public welfare, especially between the hours of 9:00 p.m. and 7:00 a.m. the following day.

55-3b(5): Noise from any sound-reproduction system operating or playing any radio, portable radio, tape player, television, tape deck or similar device that reproduces or amplifies sound in such a manner as to be heard 40 feet from its source or over any property line.

Brockport Village Code 35-6:

Disorderly Houses; unlawful assemblages; unlawful language and conduct.           

No person shall, within the limits of said Village, keep or maintain any disorderly or gambling house or house of ill fame; no person shall take part or join or aid or abet in any riotous or tumultuous assemblage or unnecessary crowds upon the streets or in the doorways or stairways adjacent thereto or loiter about such places; no person shall use or engage in any profane, vulgar or obscene language or conduct in or upon any street or public place.
